So I never thought it would happen...
As of January 21, 2018 I have my FIRST restraining order. I never expected this.
In fact, I was just minding my own business, paying my monthly $730 child support payment for my 2 year old son Everett, and then BAM.
Out of nowhere something very strange occurred to me. Why is my ex-wife's boyfriend always trying to hold my 2 year old sons hand in front of me when she picks him up?
Why does this guy keep jumping in the video when I allow my ex wife to Facetime my son? And why does this man who hasn't known my son for 6 months keep telling my son he loves him on Facetime with my ex wife?
Something seemed very off about this guy.
I couldn't explain it, but my gut told me to do a background check on him.
I didn't know his full name or birthday so I texted my ex that I need this information. Her response was to ignore that I ever asked her the question. For 2 days this went on, and then on day 3 at 7:00 am I had to threaten her with a CPS call so I can find out about this guy whom she moved in to live with my son.
She finally gave up his information, and I ran a background check. I was floored. I was shocked. I was in panic mode after what I discovered.
See, the first time my ex wife introduced me to him I asked him if he had any kids. He said yes, I have a 4 year old daughter. But I never EVER noticed this guy with his daughter. EVER.
What he failed to tell me, and what my ex wife failed to tell me, is that he's a 3rd degree felon. A violent felon at that. Living with my 2 year old son!
See, the police report paints a terrifying picture of this guy. Not the Mr. Nice Guy he always showed me. This guy actually strangled his ex wife multiple times and tried to kill her.
The police report was frightening. Every time she would struggle and escape from his grip, he actually chased her, choked her again, and kept repeating "I'm gonna kill you".
So, I immediately went to a lawyer and they did a more detailed background check. This was just 2 weeks ago by the way.
What they found is that his ex wife has had a restraining order on him since 2015. Then she renewed it in 2017 for another 2 years. She also changed her daughters last name, and has had her address concealed from public records.
She reported that he had a serious meth, cocaine, and alcohol problem, too, which may have had something to do with his behavior. And in order to be granted supervised visitations with his daughter, he had to wear a pharma patch that proved he wasn't on narcotics for at least 90 days.
He was also required to use some sort of alcohol testing device regularly, and report to A.A. and Narcotics Anonymous regularly. My lawyer revealed he had done none of those things.
My next step was to tell my ex wife that this guy is a violent felon. And this was the most disappointing thing of all. She wasn't shocked.
I kept repeating to her "you realize this guy is a violent felon, you realize his ex wife has a restraining order on him for a reason, right?"
After holding out, her response was... "I know about his past and so do my parents".
I was lost for words at this point. Our divorce decree clearly states that she is required to tell me about this. She has this guy living with my 2 year old son. The love of my life.
My next message was to her mother... "And you knew your own grandson has been living with a violent felon this whole time? What a shame for my son."
I was livid. Here I am, getting my son every other weekend, and every Wednesday. Holding up my end of the divorce decree. Struggling to pay my $730 child support dues every month.
And for at least the past 6 months she's known about this guy's history. This guy had a chance to be a father, but he pissed it away. Now it seemed he was trying to be the father to my son.
That simply wasn't going to happen, and thanks to my gut or I never would have had that suspicious feeling. I rely on my gut feelings more and more these days.
So, the restraining order has officially been approved by the judge. Yay.
The sad thing? My ex wife was actually mad at me for messing up her relationship and forcing this guy to stay away from my son. Very pathetic.
The funny thing was that she actually tried to beg me to keep the lawyers out of it. She wanted us to work this out outside of court. She kept going on about how he's this great guy, and we don't need lawyers. We don't need the expense.
Too late I told her. I drained my savings on a lawyer just so I can keep my son safe. And ouch has it hurt so far.

"You'll have to re-up your payment at least once more". See, I wasn't planning on taking my ex-wife back to court. I did it out of sheer necessity for my son.
It makes me wonder how some people can afford lawyers. It has screwed me financially.
